What the service is

Hospice Metrics (operated by Xavier Analytics LLC) organizes public data published by the Centers for Medicare & Medicaid Services into structured, source-traceable reports. Every figure is either read directly from a CMS file or derived by the pipeline and shown with its denominator and provenance.

What the service is not

The reports are not legal advice, not a legal strategy, and not a finding that any hospice did anything wrong. They make no causal claim and assert nothing about any individual patient. A figure is a starting point for a qualified reader, not a verdict, and any figure a real decision may rest on should be independently verified.

Acceptable use

You may use the reports to review public information about hospices. You may not use them to harass any person or organization, to present a product-computed figure as a CMS-published one, or to represent the reports as a determination of wrongdoing.

No warranty

The data originates with CMS and is provided as is. We take considerable care that every figure is reproducible and traces to a published source, but we do not warrant that CMS's underlying data is complete or free of error.

Reports and purchase terms

This page governs use of the Hospice Metrics website. Purchasing a report is governed by separate engagement terms provided at the time of order, covering payment, delivery, and the license granted for that specific report. Where the two conflict as to a purchased report, the engagement terms for that report control.

Limitation of liability

To the fullest extent permitted by law, Hospice Metrics's total liability arising out of or relating to your use of this site or any report is limited to the amount you paid for the report giving rise to the claim, or $100 otherwise. Hospice Metrics is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or the outcome of any legal proceeding informed by a report.

Indemnification

You agree to indemnify and hold Hospice Metrics harmless from claims, damages, and reasonable expenses (including reasonable attorneys' fees) arising from your misuse of the site or a report, or your violation of these terms.

Governing law and venue

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the site will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the jurisdiction of those courts.

Termination

Hospice Metrics may suspend or terminate your access to the site at any time, for any reason, including suspected misuse. The No warranty, Limitation of liability, and Indemnification sections continue to apply after termination.
